Joyce’s practice focuses primarily on health care issues and on the medical defense of complex toxic tort claims.

Relevant Experience

  • Participated extensively in the preparation of the medical defense of mass liability asbestos trials for asbestos product manufacturers. Evaluated medical records of plaintiffs, recruited and prepared medical experts for trial, took discovery and de bene esse depositions of physicians for trial, argued pretrial motions, and participated in court supervised settlement negotiations on behalf of the clients.

  • Serves on national team recruiting and preparing expert witnesses for testimony in defense of product liability cases for multiple clients.

  • Wrote major portions of and edited a manual for an asbestos manufacturer on the medical preparation of asbestos cases.

  • Supervised local self-insured industrial client of preparation of an aqua ammonia exposure case for trial in an out-of-state jurisdiction.

  • Served as a resource for local counsel nationwide who represented an asbestos client. Assisted in the evaluation, preparation for trial, and settlement of cases on an individual or group basis.

  • Represented a large physician group in a Department of Medical Assistance Services Formal Administrative Appeal regarding Medicaid payments.

  • Advised a physician group regarding appropriate response to hospital policy and possible EMTALA violation by hospital.

  • Conducted an extensive review and analysis for a health care system of the legal implications of permitting physicians and their office staff access to hospital medical records by computer hookup.

  • Advised institutional client regarding circumstances under which it could legitimately employ off-duty Navy physicians. Further advised the institution governing CHAMPUS and SECNAV regulations governing billing for CHAMPUS patients treated by off-duty Navy physicians at the client's facility.

  • Advised outpatient health care client on risks associated with flagging charts of patients with certain infectious diseases, including HIV and HBV.

  • Advised a physician group regarding fraud and abuse issues involved in the restructuring of a subsidiary it owns jointly with others.

  • Advised a physician group regarding workmen's compensation coverage for needlestick injuries.
